Philippines Intensifies Fight Against Agricultural Smuggling

New Enforcement Protocols Established to Combat Market Sabotage and Protect Consumers
MANILA, Philippines — The Philippine government is enhancing its campaign against agricultural smuggling with the adoption of new enforcement rules aimed at protecting farmers, fisherfolk, and consumers.

This initiative is part of the efforts spearheaded by the Anti-Agricultural Economic Sabotage (AAES) Council, which approved the enforcement guidelines in a meeting held on May 28.

The Office of the Special Assistant to the President for Investment and Economic Affairs (OSAPIEA) announced that the approved rules of engagement outline a structured framework for coordinated action against significant economic saboteurs that distort agricultural and fisheries markets.

Secretary Frederick Go, who is also President Marcos’ representative to the AAES Council, emphasized the importance of addressing the root issues leading to market distortions.

The AAES Council was established under Republic Act 12022, the Anti-Agricultural Economic Sabotage Act, which was signed into law in September 2022. This legislation aims to impose stricter penalties for various crimes linked to agricultural economic sabotage, including smuggling, hoarding, profiteering, and cartel activities.

With the law now operational, the AAES Council plans to pursue offenders vigorously to stabilize food prices and improve the quality of life for Filipinos.

The Enforcement Group, which consists of the National Bureau of Investigation, Philippine National Police, Philippine Coast Guard, and the Department of Finance (DOF), has been authorized to execute its mandate, including the identification and apprehension of smuggling and profiteering networks.

Furthermore, a team of prosecutors designated by the Department of Justice (DOJ) will expedite the filing and resolution of cases under the AAES Act.

The council has also established guidelines for declaring an “abnormal situation,” allowing for immediate interventions in response to market disruptions caused by economic sabotage or other supply chain issues.

In efforts to enhance market transparency, the Department of Agriculture (DA) has been tasked with the continued strengthening and maintenance of the Daily Price Index (DPI), which is designed to track prices and promote transparency within the markets.

To prevent price manipulation, the DPI will undergo regular audits and will be made accessible to the public.

Relevant agencies have also been directed to advance the full implementation of the National Single Window and ensure adequate storage facilities for goods seized in compliance with these enforcement actions.

In addition to the DA, DOF, and DOJ, other members of the AAES Council include the Departments of the Interior and Local Government, Trade and Industry, and Transportation, as well as the Philippine Competition Commission and the Anti-Money Laundering Council.
