Manila, Philippines — The Senate impeachment court has reaffirmed its intention to proceed with the trial of Vice President Sara Duterte, despite the expiration of the House prosecutors’ terms later this month.

Senator Sherwin Gatchalian confirmed the impeachment case is still ‘alive’ as the Senate has not dismissed the Articles of Impeachment.

The impeachment proceedings were brought to attention following the issuance of a writ of summons to Vice President Duterte on June 12, providing her with 10 days to respond.

Gatchalian emphasized that the impeachment court retains authority to convene and address developments, even in the absence of House prosecutors.

He noted that past instances had seen the court convene without prosecutions present to discuss ongoing matters.

Duterte's legal team is expected to provide a response within the stipulated timeframe, with the next court activity anticipated to occur around June 25 or 26. Each engagement of the court is confirmed through the issuance of summons, underscoring the legitimacy of the proceedings.

Outgoing Senate Majority Leader Francis Tolentino supported Gatchalian’s statements, further asserting the court's reconstitution and adoption of rules that mirror the 2012 impeachment trial of former Chief Justice Renato Corona.

He clarified his opposition to the idea of allowing the impeachment case to carry over into the next Congress, emphasizing the procedural nature of the recent Senate decision to return the Articles of Impeachment to the House for certification.

The Senate’s recent vote of 18-5-0 to return the Articles was executed with the specific aim of obtaining certifications from the House prosecutors, confirming both the constitutional validity of the complaint and the readiness of the incoming Congress to proceed with the trial.

House members indicated they are currently unable to provide the required certifications, as the 20th Congress has not yet been formed, which is a necessary step prior to any continuation of the impeachment process.
